Terms & Conditions

In these terms & conditions the term “DMT” & “we/us/our” means Dorset Marine Training, (a partnership operated by Dominic Coleman & Sarah Quinn) its Instructors, partners or any sub-contracted person. The term “the client” & you/your shall mean each person in whose name the booking is made.

Signing the booking form or making payment for course signifies acceptance of DMT’s terms & conditions.

Before booking, please satisfy yourself as to the suitability of the course you are booking and your own ability. If in any doubt please contact us. If you require any adaptions or have restricted mobility please contact us to discuss how we can assist with access to our classroom and boats.

Course enrolment does not mean that you automatically get a certificate. All courses require you to reach a certain standard at which the relevant certificate can be awarded. Students will be trained & debriefed to ensure everyone achieves their potential on the course, but Certificates can only be awarded to those reaching the required standard.  We will of course provide a plan for completion of the award.

The minimum age for all bookings is 18.  Course participants are accepted under this age but must be accompanied by a parent or guardian or booked on a specific young persons course unless otherwise specifically agreed.  All young people will require consent from their parent or guardian.

DMT will accept the booking by writing (usually via email) to the client with joining instructions.  Full payment is due at the time of booking to secure your place.

Cancellation/postponement by client: Greater than four weeks notice: Course fee repaid less £50 admin charge. Less than four weeks notice until your course: Full cost of course due unless places can be ‘resold’ in which case liability is limited to admin charge. Whether we are able to resell your place may not become clear until the date of the course. Cancellation by DMT: If for any reason we are unable to fulfil a booking or a vessel becomes unseaworthy, we will inform the Student as soon as possible. No liability shall attach itself to DMT beyond the refund of the full fee paid by the student(s) or unused portions thereof. We reserve the right to cancel a course should the numbers fail to reach a viable minimum number. No responsibility whatsoever will be accepted for client travel, accommodation or other costs. You are strongly advised to take out your own insurance to cover cancellation costs.

DMT will decide how & when any course is run & whether or not the course will go out onto the water. Our decision is final.

Individuals intending to obtain the International Certificate of Competence (ICC) are advised to check the RYA website to ensure that they satisfy the RYA rules for eligibility for the issue of this certificate. DMT cannot be held responsible if an individual books a course with a view to subsequently obtaining an ICC but the RYA rejects their application.

DMT is insured, however the client is strongly recommended to take out their own insurance against cancellation, damage or loss of personal effects, death or personal injury.  The client acknowledges that there are inherent dangers involved in sports / powerboating & understands & agrees to sign the booking form indemnity holding DMT & it Instructors free of liability in the event of an accident, death, injury or damage to person or property. The Client understands that the vibration that occurs as a boat moves across waves & wash can exacerbate existing conditions & agrees to advise the Company of any relevant conditions.

The Training Centre & Instructors, do not accept responsibility for any loss, damage or injury suffered by persons &/or their property arising out of or during the course of the activities whilst training &/or coaching &/or instructing &/or delivering unless such injury loss or damage was caused by, or resulted from negligence or deliberate act.

By ticking the box on the booking form you consent to any photos & videos that are taken of you during training being used in publicity material/websites/social media. You also consent to any feedback given to us being used in these same places.

GDPR Info:

The information you provide will be used by us to process your booking for the course & for attending to your safety whilst you are on one of our courses. Our full privacy policy is available on our website or by request. Names & addresses of candidates for some RYA courses will need to be shared with the RYA. If this presents a problem please notify us.  For information of retention of your information by ourselves please see our Privacy Policy.

Online Courses – To enable access to your online course we need to share some of your personal data with the RYA via your user profile in www.ryainteractive.org. This learning management website is hosted and maintained by a third party called Learning Pool, who will not use your personal information for any reason other than enabling your course.

Your name and email address will be entered on www.ryainteractive.org in order to create your user account. On your first access to the site, you will be asked to enter your address and date of birth. You will have access to the site for one year in order to complete your online course. During this period, your personal information will be held on the website by Learning Pool and be available to this training centre and the RYA for the purpose of managing your course.

Instructional support will be provided by this training centre for a period of 12 months from the date of your course booking.

On completion of your course, your name, email, date of birth and address will be transferred to the RYA’s central database for the purpose of recording details of the course and any certification you gain as a result of it. This information allows the RYA to record your certification, to update any records they may already hold about you or your qualifications and to verify your certificate if required. After one year from the date of your enrolment on the course, your user account will be removed from www.ryainteractive.org.

Full details of how the RYA will deal with your personal information will be displayed when you first access www.ryainteractive.org.

Distance Sales

Course delivery: Once payment has been made & confirmed students will be sent the student pack. The student pack and login information will be sent within 48hrs (business days) & delivery to mainland UK is included in the course price. 

Students must have access to the internet & email to complete the course. The course is not transferable & access is for the named applicant only.  Course enrolment does not mean that you automatically get a certificate. All courses require you to reach a certain standard at which the relevant certificate can be awarded.

Under Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have a statutory cooling off period of 14 days from the day after you purchase your goods or service. (Please note that this does not apply to digital downloads as explained in the tick box at checkout).  At any time during this period you can notify us that you wish to cancel your contract & we will give a full refund including any initial delivery charges. Any course materials must be returned in an ‘as new’ condition & the return postage paid by the client. If the course materials are being returned because they are faulty or not as described and this is found to be the case then we will refund any postage costs.  Access to any online course material is terminated immediately. You will not be able to claim a full refund if the course material has been damaged. We reserve the right to deduct for the net cost of any missing or damaged course materials & postage.  If your training is due to commence within 14 days or if you wish to start your online course immediately you waive your right to cancel and/or will be liable for reasonable costs incurred.  We are unable to refund costs for digital content on online courses.

Whilst we would anticipate you finishing the course within a much shorter timescale, the course will be valid for a maximum period of 12months.   If you are struggling with the course please contact us for assistance.  Initial free advice will be offered by telephone.  If you require more in-depth teaching or classroom time then a fee may be incurred but we would discuss this with you.
